GENERAL TERMS AND CONDITIONS OF HIRE AND DELIVERY
Delivery
The times for assembly and disassembly shall be agreed in mutual consultation with the client. All goods provided by the lessor shall in principle be assembled and collected on the ground floor, unless the parties have agreed otherwise for whatever reason. The lessee must present a valid proof of identity (passport, driving licence or identity card) if so requested.
Pre-Motion shall endeavour to be on-site to perform assembly and disassembly work at the agreed time. The client shall ensure that someone is on-site at that time and that he/she has prepared everything (the floor, for example, or, if the installation is to be placed on an item of furniture, he/she must ensure that this is ready), so that the installation engineer can begin work immediately.
In addition, a working 230 VAC electricity supply point (double socket) must be available on the site where the system is to run. If our installation engineer is kept waiting due to fault on your part, we shall charge an hourly rate of €45 for this.
Assembly and disassembly times
In principle, we can install the system Monday to Saturday inclusive between the hours of 06.00 and 20.00. Outside of these hours, an additional charge of € 125 shall apply over and above the normal rate. We do not carry out assembly nor disassembly work on Sundays.
Conditions of payment
The amount due must have been credited to the account of Pre-Motion no later than 5 days prior to the planned activity. Specific payment conditions shall only be possible in consultation with Pre-Motion and if these have been confirmed in writing.
Cancellation
In the event that the lessee chooses to cancel four weeks before the scheduled date or earlier, an amount equal to 15% of the contract sum shall be charged. If the lessee cancels between four weeks and one week prior to delivery, a compensatory charge equal to 50% of the contract sum shall apply. If cancellation takes place within 1 week prior to the delivery date, you shall be charged for the full agreed contract sum.
Damage
The lessee is obliged to report any damage sustained to and any defects of the hired goods to the lessor immediately. The lessee may not undertake repairs without the consent of the lessor. We shall ascertain in all reasonableness whether you are partly or entirely liable for the damage in each case.
The amount of compensation for damage shall be equal to the costs of repairing the damage, subject to a maximum of the cost of replacement (though these costs shall never be more than the cost of replacement). Bars must not be covered with posters, painted or treated in any other way. The lessor shall not be liable for damage in relation to the hired goods that is caused to persons and/or property of third parties.
The lessee shall bear the contractual and statutory risk associated with what is known as product and services liability from the time at which the goods are made available to it until the time at which the goods are once again in the possession of the lessor. During the period stated in the previous sentence, the lessee shall therefore indemnify the lessor against all claims that may be enforced against the lessor by third parties in connection with the hired goods.
Sushi plates
If you are hiring sushi plates, we recommend that you wash them once or wipe them with a cloth prior to using in catering. They have been washed, but although we endeavour to deliver them clean, there may be limescale or any dust that has accumulated in storage on the plates. The plates must be returned to us clean. If they are returned dirty, a charge of €0.30 per plate for cleaning costs shall apply. If any plates are missing upon return, you will be charged €2.50 per missing plate. We would appreciate it if the plates are returned sorted by colour in the supplied crates.
Theft
If the item is stolen during the hire period (from the time of delivery until the system is collected), you shall be responsible for the losses incurred as the lessee. This sum shall be equal to the cost of replacing the item, minus the hire costs already paid. It may be the case that you are insured against such an occurrence, depending on your insurance company.
Technical faults
Pre-Motion ensures that the technical elements of its products are kept in optimum condition. If anything should occur during the hire period that results in a situation in which this is no longer the case, the lessee is required to contact the Pre-Motion technical service as soon as possible on +31 (0)318507600. A member of staff at Pre-Motion will endeavour to resolve the issue as soon as possible.
This may mean that the item is repaired on-site or that it is collected for repair. In the latter case, the member of staff at Pre-Motion will seek a suitable solution in consultation with the lessee with regard to replacing the item for the remaining hire period.
Pre-Motion cannot be held responsible under any circumstances for any consequential losses whatsoever. Pre-Motion shall be willing in all reasonableness to consider the hire sum paid and to bear part of your costs. However, this shall only apply if a clear cause can be ascertained and the defect has not been caused by an incident for which the lessee may be held liable. With regard to the water system, the client shall expressly take responsibility for maintaining a good standard of water quality.
