1. Delivery of rental products
Small electric turntables (with its own weight up to a max. of 25 kg) are collected by agreement by the lessor from Pre-Motion in Ede (Netherlands), or sent by Pre-Motion to the lessor’s address in a sturdy case. After the agreed rental period has elapsed, the lessor returns the rotating platform to Pre-Motion in the sturdy case. The cost of returning the equipment is borne by the lessor. If the equipment leased is not returned immediately when the agreed rental period has elapsed, the lessor is given another option to return the rental items, or to declare theft of the items, after this is established by Pre-Motion. In this case, the rental period ends as soon as the hired item(s) is/are returned. If the lessor has not returned (or not reported the theft of) the rental items after the agreed time period has elapsed, he/she is in default. In addition to the original hire rate, in this case the lessor is liable for the purchase price of the unreturned product to Pre-Motion. The lessor remains liable for any damage or loss during the return shipment, regardless of whether he/she is responsible for the damage, loss, theft or rendering the rental item or items unusable or worthless.

Rental products which the lessor can install himself/herself (including the Catwalker Compact and large rotating platforms of < Ø 3 metres), are collected from Pre-Motion by the lessor as per agreement, or sent to the lessor’s address by Pre-Motion via a transport firm. The lessor is responsible for sufficient technical insight in order to complete the structure as per Pre-Motion’s instructions, as well as the care (and any transport) of the hired product. In the event of any uncertainty or lack of information, the customer can contact Pre-Motion directly for advice (by telephone). If this does not lead to a workable solution, Pre-Motion can - if the schedule allows - take care of installation on the lessor's behalf. Additional transport and installation costs for this last-minute support on location are at the lessor's expense. If the lessor has not returned the hired items after the agreed time period has elapsed, he/she is in default. In addition to the original rental rate, in this case the lessor is liable for the cost and extra daily rental rates for the unreturned product to Pre-Motion.

If the hired product is installed on location by Pre-Motion, the lessor is obliged to ensure that a suitably authorised person is present during the agreed day of installation/delivery for accepting delivery of the hired items and supervision during the installation. If there is no such person present during delivery, Pre-Motion has the right to not deliver the rental items. In such case, the lessor will owe Pre-Motion for costs incurred. If a Pre-Motion technician is obliged to wait for the lessor, Pre-Motion will charge an hourly rate of € 45.- per employee for this.

2. (Dis)assembly of products installed by Pre-Motion 
The times for assembly and disassembly shall be agreed in mutual consultation with the client. All goods provided by the lessor shall in principle be assembled and collected on the ground floor, unless the parties have agreed otherwise for whatever reason. The lessee must present a valid proof of identity (passport, driving licence or identity card) if so requested. In principle, we can install the system Monday to Friday between the hours of 07:00 and 19.00. Outside of these hours, an additional charge of € 150.- shall apply over and above the normal rate. Please note: we do not carry out assembly nor disassembly work on Sundays.

Pre-Motion shall endeavour to be on-site to perform assembly and disassembly work at the agreed time. The client shall ensure that someone is on-site at that time and that he/she has prepared everything (the floor, for example, or, if the installation is to be placed on an item of furniture, he/she must ensure that this is ready), so that the installation engineer can begin work immediately.

In addition, a working 230 VAC electricity supply point (double socket) must be available on the site where the system is to run.

3. Payment
The amount due must have been credited to the account of Pre-Motion no later than 5 days prior to the planned activity or transport. Specific payment conditions shall only be possible in consultation with Pre-Motion and if these have been confirmed in writing.

4. Cancelling
In the event that the lessee chooses to cancel six weeks before the scheduled date or earlier, an amount equal to 25% of the contract sum shall be charged. If the lessee cancels between 6 weeks and one week prior to delivery, a compensatory charge equal to 50% of the contract sum shall apply. If cancellation takes place within 1 week prior to the delivery date, you shall be charged for the full agreed contract sum.

5. Damage or theft
The lessee is obliged to report any damage sustained to and any defects of the hired goods to the lessor immediately. The lessee may not undertake repairs without the consent of the lessor. We shall ascertain in all reasonableness whether you are partly or entirely liable for the damage in each case.

The amount of compensation for damage shall be equal to the costs of repairing the damage, subject to a maximum of the cost of replacement (though these costs shall never be more than the cost of replacement). Without permission in writing by Pre-Motion, the lessee is not allowed to decorate (e.g. with posters or stickers), paint or treat the hired goods in any other way. The lessor shall not be liable for damage in relation to the hired goods that is caused to persons and/or property of third parties.

The lessee shall bear the contractual and statutory risk associated with what is known as product and services liability from the time at which the goods are made available to it until the time at which the goods are once again in the possession of the lessor. During the period stated in the previous sentence, the lessee shall therefore indemnify the lessor against all claims that may be enforced against the lessor by third parties in connection with the hired goods.

If the item is stolen during the hire period (from the time of delivery until the system is collected), you shall be responsible for the losses incurred as the lessee. This sum shall be equal to the cost of replacing the item, minus the hire costs already paid. It may be the case that you are insured against such an occurrence, depending on your insurance company.

6. Technical issues
Pre-Motion ensures that the technical elements of its products are kept in optimum condition. If anything should occur during the hire period that results in a situation in which this is no longer the case, the lessee is required to contact the Pre-Motion technical service as soon as possible on +31 (0)318505780. A member of staff at Pre-Motion will endeavour to resolve the issue as soon as possible.

This may mean that the item is repaired on-site or that it is collected for repair. In the latter case, the member of staff at Pre-Motion will seek a suitable solution in consultation with the lessee with regard to replacing the item for the remaining hire period.

Pre-Motion cannot be held responsible under any circumstances for any consequential losses whatsoever. Pre-Motion shall be willing in all reasonableness to consider the hire sum paid and to bear part of your costs. However, this shall only apply if a clear cause can be ascertained and the defect has not been caused by an incident for which the lessee may be held liable.
